Abhishek Banerjee, the national general secretary of the All India Trinamool Congress (AITMC), has moved the Supreme Court against an order of the Calcutta High Court. The High Court had imposed costs of ₹25 lakh on him and allowed the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI) to conduct a probe against him in the school jobs for cash scam.
Senior Advocate Abhishek Manu Singhvi mentioned the matter before a vacation bench of Justices Aniruddha Bose and Sanjay Karol, and the court agreed to list the plea on Friday, May 26.
Justice Abhijit Gangopadhyay of the Calcutta High Court had previously ordered a CBI and ED probe against Banerjee in the school jobs for cash scam. The order was based on a plea filed by the ED, seeking protection for its officers against action by the State Police. The accused, Kuntal Ghosh, had made allegations against the officers, claiming torture and coercion to implicate Banerjee in the case.
Both Banerjee and Ghosh had filed applications to recall the order passed by Justice Gangopadhyay, but their applications were dismissed by Justice Amrita Sinha on May 18. Justice Sinha also imposed costs of ₹25 lakh on each of them. In her order, she criticized the CBI and the ED for the slow pace of the investigations and questioned the lack of new and recent developments in the information presented by the agencies.
Supreme Court intervened in the matter. On April 17, the Supreme Court stayed the April 13 order of the Calcutta High Court that had directed a CBI and ED probe against Abhishek Banerjee in the school jobs for cash scam.
Furthermore, on April 28, the Supreme Court directed the Acting Chief Justice of the Calcutta High Court to reassign the matter related to the Primary Teachers' Recruitment Scam in West Bengal to another judge.
