In a recent order the Rajasthan High Court held that, a government servant challenged his transfer order on the grounds that he is having inconvenience since he has school-going children and old parents to take case.
The bench of Justice Vinit Kumar Mathur refused to interfere with the transfer order, stating that no malafide had been alleged and there was no evidence that the authority who passed the order was not competent.
The court also noted that the petitioner was a government servant and therefore liable to be transferred in administrative exigency.
The court concluded by dismissing the writ petition on the grounds raised by the petitioner saying it did not warrant interference.
