SC stays demolition of Coke plants in Meghalaya

The bench of Justices Surya Kant and Dipankar Datta of the Supreme Court has stayed the demolition of Coke Plants in Meghalaya which does not have consent to operate.

The Meghalaya High Court had directed the petitioners to approach the Board and the petitioners had approached the board but suddenly the order of demolition was passed. The order has been passed for the East Janitia Hills district.

It was argued before the Supreme Court that similarly situated Coke Plants have not been touched and an order of demolition has been passed. It was also argued that once the consent to operate is applied and not granted within 4 months there is a deemed consent o operate. It was also argued that the demolition has been ordered of the plants which were not operated. 

The Supreme Court has directed the State to file its response and also permitted to impleaded the original writ petitioner Monu Kumar and permitted to file a counter affidavit.
