SC says automatic vacation of stay requires revisit: creating problems

The bench of Justice Justice BR Gavai and Justice Prakash Kumar Mishra said that judgment of the Supreme Court wherein it has been held that all the Stay Orders would be vacated after a period of 6 months requires a revisit.

Attorney General of India R. Venkataramani stated in the court that it requires re-consideration, because this is creating a lot of problems. The AG agreed with Court and said "I will look into it. As far as criminal matters are concerned, we need to collect data on how it really works".

During the hearing of a case Justice Mishra said, ""This is happening everywhere, some Courts write to the High Court seeking directions, some pass recall orders on their own without hearing the other side."

6 months stay vacation judgement

The Court orally said that the case of Asian Resurfacing of Road Agency Pvt. Ltd. VS. Central Bureau of Investigation requires revisit.
