SC refuses to hear petition of Gymnastics Federation of India challenging orders of Delhi HC

Yesterday, the Top Court refused to entertain a plea of the Gymnastics Federation of India,the Court during the hearing directed them to approach the Delhi High Court instead for reliefs pertaining to the elections for the sports body scheduled for Thursday.

Early in September, the division bench of Delhi High Court noted the submissions made by senior advocate Rahul Mehra, who had filed a PIL back in 2010 seeking reforms in sports bodies, that elections to various sports associations were held in violation of its 2022 judgement.

The high court has issued a clear directive to the Central government, requesting a response within a four-week timeframe. This directive emphasizes the importance of strict adherence to the court's ruling from August 16, 2022, for all upcoming elections. The court's previous ruling on that date included various instructions to the Centre, such as refraining from granting recognition or facilities to sports bodies that do not adhere to the sports code, implementing structural reforms to address mismanagement in sports associations, and promoting democratization within these organizations.

Aggrieved by the order of the Supreme court, Gymnastics Federation of India (GFI) said it was passed without hearing the sports body and came just a day before the elections that are scheduled for Thursday.

“We are not going to entertain it at this stage,” a bench comprising Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra said, and asked the counsel for the GFI to approach the Delhi High Court.

In the ongoing proceedings at the high court, a Public Interest Litigation (PIL) has been filed by senior lawyer Rahul Mehra. In this PIL, Mr. Mehra has requested various remedies, one of which is the enforcement of the national sports code.
