Today, the Supreme Court imposed cost on a petitioner who contested the selection of Justice Devendra Kumar Upadhyaya as the Chief Justice of the Bombay High Court.The Petitioner alleged that the oath administered to Justice Upadhyaya alleged that the oath administered to Justice Upadhyaya was flawed.
The bench, which included Chief Justice of India DY Chandrachud, along with Justices JB Pardiwala and Manoj Misra, emphasized that the Court has a threshold for dealing with trivial or baseless cases.
During the hearing today, CJI remarked -

The petitioner's counsel contended that during the Chief Justice's oath, the word 'I' was not used before stating his name, which, in their argument, violated the guidelines set forth in the Third Schedule of the Constitution. Additionally, it was claimed that no representatives from the Dadra and Nagar Haveli and Daman and Diu were invited to the swearing-in ceremony
The Bench noted that objections related to the oath, given that it was administered by the Governor and subsequently subscribed to, could not be raised.
