Petition challenging Rahul Gandhi's election from Wayanad dismissed by SC

Supreme Court dismissed a petition challenging the election of Congress Ex-President and politician Rahul Gandhi from the Wayanad constituency in Kerala in 2019 for Lok Sabha.

The bench of Justices AS Bopanna and Dipankar Datta dismissed the petition filed by Saria Nair against the order of the Kerala High Court dated 31.10.2019. The Kerala High Court had dismissed the election petition filed by one Sarita Nair challenging the Lok Sabha election in Wayanad and Ernakulam were dismissed.

The SLP filed before the Supreme Court against the High Court was dismissed for nonprosecution in 2020. Later a restoration application was filed. The petition dismissed for nonprosecution was restored to its original number and later the SLP was dismissed. 

Petitioner Sarita Nair submitted her nomination for contesting election from Wayanad and Ernakulam but the same was rejected as her conviction in two Criminal cases was not suspended. The High Court held that only the sentence was suspended and not the conviction.
