Supreme Court, with a bench headed by Justice Bela Trivedi, made a remark stating that luxury cannot be expected in jails. This comment was made during the hearing of a plea filed by Harsh Dev Thakur, who was seeking temporary bail in a case of financial fraud.
The petitioner's counsel argued that the petitioner was not living in luxury while in jail. On the other hand, the counsel for the respondents argued that the petitioner had diverted funds amounting to over Rs 2.5 crores.
The petitioner's counsel further claimed that it was impossible for the petitioner to arrange funds while incarcerated, as all their assets, including shares and mutual funds, had been seized.
The petitioner's counsel also pointed out that the High Court had previously denied bail, citing that the petitioner had already been granted bail by the Supreme Court. They also mentioned that the trial was not progressing, stating that the prosecution witnesses were not appearing.
In response, the bench, including Justice Prashant Kumar, questioned whether the witnesses were scared of the petitioner. The court dismissed the petition, ordering the trial to be expedited. The petitioner's request for a specific time frame for the trial to be completed was rejected by the court, stating that they could not provide a time frame.
However, the court granted the petitioner permission to file for temporary bail if the trial is not completed within a reasonable time period.
