Today, Editor-in-Chief Prabir Purkayastha and Human Resources head Amit Chakraborty approaches the Supreme Court and filed Special Leave Petition challenging the decision of the Delhi High Court, which had upheld their arrest by the Delhi Police in a case related to the Unlawful Activities Prevention Act. This case pertains to alleged Chinese funding aimed at promoting anti-national propaganda.
Senior Advocate Kapil Sibal brought the petition to the attention of Chief Justice of India DY Chandrachud, requesting an expedited listing.
CJI Chandrachud directs Sibal to distribute the necessary documents and indicated that he would make a decision regarding the listing. This development follows the dismissal of the petition by a bench led by Justice Tushar Rao Gedela of the High Court. The High Court upheld the legality and validity of the accused individuals' arrests.
On the 3rd of October, Delhi Police arrested them following extensive raids conducted at the NewsClick office as well as the residences of its editors and reporters. The primary argument raised in their petition was that the arrests were flawed because they were not provided with written notification of the grounds for arrest. They only received a copy of the FIR after approaching the Court and obtaining an order for it.
They cited the recent Supreme Court judgment in Pankaj Bansal v. Union of India, which invalidated arrests by the Enforcement Directorate in a case where the grounds of arrest were not furnished in writing.
In the judgment, the High Court held that the Pankaj Bansal case, which was rendered in the context of the Prevention of Money Laundering Act, was not applicable to the UAPA.
