Nawab Malik's health is deteriorating; Bombay HC scheduled a hearing for January 6, 2023

On Tuesday, the Bombay High Court denied NCP leader Nawab Malik an urgent hearing on his application for bail on merits and medical grounds in a money laundering case, despite the fact that one of his kidneys had failed. When the case was called before single-judge Justice MS Karnik, he asked Malik's counsel Senior Advocate Amit Desai to first satisfy the urgency for hearing the case.

“I am granting this indulgence only for medical reasons; and if treatment is not available”, the judge stated at the outset.

The judge noted that the counsels could always approach the vacation bench in an emergency.

The ED arrested Malik in February of this year, accusing him of usurping a property in Kurla between 1999 and 2006 with the assistance of global terrorist Dawood Ibrahim's late sister Haseena Parkar. According to the agency, because Parkar handled the gangsters' illegal businesses, the money was eventually used for terror funding. For Rashmikant and Partners, Senior Advocate Amit Desai, assisted by Advocate Pooja Kothari, submitted that Malik's medical condition was critical. Doctors believe he should be kept under observation because he has increased blood traces in his urine and may require a transplant. As a result, he believes the case should be heard as soon as possible.

According to the ED, Malik conspired with D-gang members Haseena Parker (late), Salim Patel (late), and Sardar Khan (1993 bomb blast convict) to usurp one Munira Plumber's 3 acre ancestral property in Kurla for a pittance despite the property's ready reckoner rate being Rs 3.54 crore between 2003-05.

According to the agency, a power of attorney granted by Plumber to Patel and Khan for the purpose of removing encroachments on her land was abused in order to sell the property to a company owned by Malik's family.
