Recently, Jharkhand High Court seeks a response from the State government and the Bar Council of India, in a plea seeking medical insurance for lawyers and their dependents.
The division bench, headed by Justice Sanjaya Kumar Mishra and Justice Ananda Sen directed to submit a response within 1 month.
In the said matter, the plea was filed by Bidesh Kumar Dan, in which he mentioned that due to the spread of Covid-19 and the non-functioning/partial functioning of courts since March 2020, the livelihood of advocates was severely affected and therefore it is the duty of the authorities to help them in this period of crisis.
Advocates could not do any other job due to the fact that they are prohibited to do so by applicable law, the plea stated.
"Section 6 and 7 of The Advocates Act, 1961 casts a duty upon Respondent No.-4 (BCI) and Respondent No.-5 (JSBC) and to provide financial assistance to organize welfare schemes for the indigent, disabled or other advocates, but due to the fact that a number of needy advocates is very large, the JSBC and BCI could not help them monetarily and they need government aid and support to do so," stated the plea.
Therefore, Bidesh Kumar, Dan approaches High Court and sought directions from the Ministry Of Law And Justice and the Government of Jharkhand to immediately provide financial aid to Jharkhand State Bar Council, so that it may support all the needy, regular practitioner advocates in the State.
After hearing a said matter, the Court respond,
"Let counter affidavit be filed by the Union of India, State of Jharkhand, Bar Council of India and the Jharkhand State Bar Council within four weeks’ time," the order said.
