Recently, the division bench of Bombay High Court observed that primary education is now held to be a fundamental right of children aged between five and 14 years, it is the duty of the government to provide education with all attending facilities and requirements.
A division bench of Acting Chief Justice Sanjay V Gangapurwala and Justice Sandeep V Marne was hearing a PIL filed by one Aqueel Khaleel Mujawar through advocate Hanif Shaikh.
In the said matter, the court directed the state government and Sinnar Municipal Corporation in Nashik to make Pavitra Portal for appointments of teaching and non-teaching staff in the state be made operational for Urdu medium teachers and the same should be maintained within short time.
While rejecting a PIL raising concerns over the difficulties faced in the non-filling of the posts of teaching and non-teaching staff, and non-maintaining the Pavitra Portal for Urdu medium teachers.
The petitioner in its PIL claimed that the basic facilities of the benches and classrooms are not being provided and there were 55 vacancies of the teaching staff in the civic body along with non-availability of basic facilities.
The petitioner stated that in one school at Jadav Wadi in Sinnar, 300 students are being taught in one classroom.
Advocate Deepak More for the civic body submitted that the staff have been filled in every school and that the Jadhav Wadi school will be shifted to a new building on June 1. More added that the required facilities of benches and classrooms have been provided to students and teaching and non-teaching staff have been filled in as admissible and sanctioned.
The court said the education officer is also expected to verify that appointments for teaching and non-teaching staff are made as per roster and as per sanctioned posts and if such posts are not filled, necessary directions be issued to the municipal corporation.
