The Hindu side has filed a caveat before the Supreme Court after the Allahabad High Court rejected the Muslim side's plea challenging the maintainability of lawsuits filed by Hindus in the Shahi Idgah Mosque-Krishna Janmabhoomi dispute in Mathura.
In its caveat, the Hindu side requested that no orders be passed without hearing them if an appeal is filed in the Supreme Court.
Justice Mayank Kumar Jain of the High Court delivered the verdict on August 1, 2024, which had been reserved since June 6, 2024. Justice Jain is handling 18 related suits, consolidating 15 for a joint hearing. The Muslim side had challenged the maintainability of these lawsuits under Order 7 Rule 11 of the CPC, which assert that the 13.37 acres of land in Mathura, including the Shahi Idgah mosque area, belong to Krishna Janmabhoomi.
The lawsuits seek the removal of the mosque from the contested land. Devotees of Lord Krishna claim that the Shahi Idgah Mosque was built on the deity's land, which they believe is the actual birthplace of Lord Krishna. It is alleged that the mosque is an illegal structure erected over the Krishna Janmabhoomi land.
Last year, the Supreme Court declined to stay the Allahabad High Court's decision to transfer all suits related to the Krishna Janmabhoomi-Shahi Idgah dispute from the Mathura Court to itself
