Delhi Riots 2020 | Justice PK Mishra recuses from Hearing Umar Khalid's Bail Plea

Today, while adjourned the hearing of bail application of activist Umar Khalid, the judge Justice Prashant Kumar Mishra of the Supreme Court recused himself

The matter was heard before a divisiion bench of Justices AS Bopanna and Prashant Kumar Mishra. 

During the course of hearing, Justice Bopanna said, "This will come before some other bench. There is some difficulty on part of my brother".

Khalid has been behind bars since September 2020, awaiting his trial in the case under the Unlawful Activities (Prevention) Act for his alleged involvement in the larger conspiracy surrounding the communal violence that broke out in February 2020 in Delhi.

The Court was considering Khalid's Special Leave Petition that contested the Delhi High Court's previous year's ruling to reject his bail request.

The Supreme Court acknowledged the activist's appeal on May 18, subsequent to which the bail proceedings were rescheduled two times. Initially, on July 12, the Delhi police requested an extension to submit a counter-affidavit, leading to an adjournment.

Later, on July 24, counsel for Khalid circulated a letter requesting a postponement. Presently, Khalid has been confined for a duration exceeding 1050 days.

The bench directed that the matter be placed before another composition on August 17. Senior Advocates Kapil Sibal and Chander Uday Singh appeared for Khalid. Advocate Rajat Nair represented the Delhi Police.
