Today, the Delhi High Court directed the Delhi Police to submit a chart delineating the specific role of Sharjeel Imam in comparison to those of the individuals who have been granted bail in the Delhi Riots conspiracy case.
Back in June 2021, the Delhi High Court granted bail to Asif Iqbal Tanha, Devangana Kalita, and Natasha Narwal in this case.
Nevertheless, the Supreme Court specified that the order should not be regarded as precedent, emphasizing that the High Court had already delved into the merits of the case.
A Division Bench of Justices Suresh Kumar Kait and Manoj Jain was hearing Imam's bail plea in the case today. The Bench instructed both Sharjeel Imam's counsel and the Delhi Police to submit their written submissions in the case.
It then listed the case for further proceeding on February 19.
Special Public Prosecutor (SPP) Amit Prasad, representing the Delhi Police, asserted that in accordance with the Supreme Court's decision rejecting the Delhi Police's appeal against the bail granted to Tanha, Kalita, and Narwal, the onus is now on Sharjeel Imam to present his case based on merits. Prasad emphasized that it is not the prosecution's responsibility to demonstrate the distinctions in their roles compared to those who have been granted bail.
The Delhi Police has accused Sharjeel Imam of being a pivotal figure in the conspiracy behind the 2020 Delhi riots. According to the prosecution, Imam and his associates allegedly conspired to orchestrate riots, utilizing the protests against the Citizenship Amendment Act (CAA) and the National Register of Citizens (NRC) as a façade.
The Bench, led by Justice Kait, is hearing Sharjeel Imam's bail plea following the elevation of Justice Siddharth Mridul, who earlier scrutinized the case in detail, to the position of Chief Justice of the Manipur High Court.
