Aam Aadmi Party's Arvind Kejriwal government has once again approached the Supreme Court. The Delhi government has appealed to the top court that the Central Government's NCTD (Amendment) Act, 2023 should be heard as soon as possible.

Delhi government told the Supreme Court that the officers are not following the orders of the government. At the same time, the Supreme Court asked Delhi and Central Government to prepare a compilation of the case in four weeks.

Senior advocate Abhishek Singhvi, appearing for the Delhi government, before a bench comprising Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra requested that the case be listed before a five-judge Constitution bench for urgent hearing.

Singhvi said, "I cannot express the pain of the Delhi government." "There are old cases of the Constitution bench. We are listing and two hundred and seven-judge bench cases are also coming up. All these are also important and have been pending for years." CJI said, it can be listed after some time. However, the bench asked Singhvi and Additional Solicitor General Sanjay Jain to sit together and decide the legal questions to be decided by the Constitution bench in this dispute.

The Centre's new NCTD (Amendment) Act, 2023 has been passed by both the Houses of Parliament and has also received assent from the President. This law gives the central government control over the bureaucrats in the Delhi government. Recently, the Supreme Court had sought a reply from the Central Government on the petition of Delhi Government.

Delhi Government (Amendment) Bill 2023 becomes law, the Lieutenant Governor in the capital has the right to take the final decision on transfer and posting of officers.
