On Wednesday, a division bench of the high court issued a stay on a ruling by Justice Abhijit Gangopadhyay concerning purported irregularities in the selection process of candidates for medical courses through the National Eligibility Entrance Test (NEET).
Earlier this month, Ishita Soren from Bankura presented a case before Justice Gangopadhyay, asserting that despite achieving the necessary marks in the NEET and being eligible for admission under the reserved quota, she was unsuccessful in securing a slot in the medical course.
Furthermore, she accused 27 candidates of securing admission by submitting counterfeit certificates to falsely assert eligibility under the reserved category. In her legal proceedings, she included all these individuals as parties to the case.
In response to Soren's petition, Justice Gangopadhyay instructed all 27 candidates to submit affidavits detailing their positions on the matter.
On the preceding Friday, nearly all the affidavits were submitted. Upon reviewing the documents, the court identified apparent irregularities in admissions under the reserved category. As a result, the court summoned the Director of the Central Bureau of Investigation (CBI) to appear virtually before it on the upcoming Wednesday.
However, on Wednesday, the state filed an appeal before a division bench led by Justice Soumen Sen, contending that the trial court had issued the order without giving the state an opportunity to present its case. In response, the division bench imposed a stay on Justice Gangopadhyay's order and opted to conduct a thorough hearing on the case.
