Today, the Supreme Court of India rejects the plea filed by Tamil Naidu Minister Senthil Balaj challenging ED Custody in the money laundering case.
A division bench of Justices AS Bopanna and MM Sundresh rejected the petitions filed by Balaji and his wife Megala challenging the orders of the Madras High Court's allowed the Enforcement Directorate to take Balaji into police custody.
The Court allowed the Directorate of Enforcement to have Balaji's custody till August 12
''The word "such custody" under 167(2) of the Code of Criminal Procedure would include police custody''
Further, the bench mentioned that writ of habeas corpus was not maintainable against an order of remand.
By giving reference for the judgment in Anupam Kulkarni, the Court held that police custody is not permissible beyond first 15 days of remand, to larger bench for reconsideration.
