On Wednesday, the Bombay High Court issued a notice to Maharashtra Speaker Rahul Narwekar and the 14 MLAs affiliated with the Uddhav Thackeray group. This action follows petitions filed by Chief Minister Eknath Shinde-led Shiv Sena, challenging Narwekar's decision not to disqualify the mentioned lawmakers.
Furthermore, a division bench comprising Justices Girish Kulkarni and Firdosh Pooniwalla has extended notice to the Maharashtra Legislature Secretariat. The bench has instructed all the respondents, including Maharashtra Speaker Rahul Narwekar, the 14 MLAs, and the Legislature Secretariat, to submit their affidavits in response to the petition.
The petitions submitted by Bharat Gogavale, the chief whip of the Shinde-led Shiv Sena, contest the "legality, propriety, and correctness" of the order issued by Speaker Narwekar on January 10.
This order dismissed the disqualification petitions that Gogavale had filed against the 14 MLAs associated with the rival camp.
Gogavale has appealed to the High Court, requesting it to declare the speaker's order as legally flawed, to quash the order, and to disqualify all 14 MLAs affiliated with the Thackeray group – Sena (UBT).
“Issue notice to all respondents. Reply affidavits if any to be filed in advance and copies to be served on the petitioner. Matter to be listed on February 8,” the court said.
The bench has scheduled the hearing for this matter on February 8th.
