Bharatiya Janata Party (BJP) leader, Dr. Subramanian Swamy, filed a petition in the Supreme Court, challenging decision of the Madras High Court, permitted a foreign trading company named Advantage Strategic Consulting to pursue a defamation lawsuit against him in the High Court of Singapore.
A division bench of Justices Surya Kant and Dipankar Datta issued a notice to Advantage Strategic Consulting in response to a case. Furter, the Court orally advised the firm to refrain from pursuing the defamation proceedings during this interim period.The case before the Supreme Court involves a challenge against a ruling made by the Madras High Court in April of the present year. The dispute originates from the objections raised by the firm, Advantage Strategic Consulting, concerning purported unverified references made by Dr. Subramanian Swamy during a press conference in April 2012. These references were allegedly related to the 2G spectrum case.
Back in 2014, a single judge of the Madras High Court had restrained the firm from filing a defamation suit against Dr. Swamy in Singapore. However, in a judgment dated April 18 of this year, a division bench consisting of Justices SS Sundar and PB Balaji set aside this injunction order. The division bench held that the Court did not have the authority to issue an anti-suit injunction against a foreign company. The High Court ruling also stated that it was not within its purview to determine whether the Singapore High Court possessed jurisdiction in the matter.
Dr. Subramanian Swamy has challenged this verdict in an appeal filed through advocate Baani Khanna.
