On a petition filed by advocates before the Division Bench of Rajasthan High Court against the order of Single Bench challenging the rules made by the Bar Council of Rajasthan being ‘The Bar Association's Rules of Rajasthan Rules, 2013’ to promote the growth of Bar Association and implementation of welfare schemes and also to improve elections process in the Bar Associations in the State of Rajasthan, held that the election in the Bar Association across Rajasthan would take place on 2nd (Second) Friday in the Month of December every year or two years depending upon the constitution of the respective Bar Association.

Advocate Abhinav Sharma along with Prahlad Sharma, Balram Jakhar, Gunjan Kumawat, Banshidhar Sharma, Narendra Singh Shekhawat and Puja Sharma represented the petitioners whereas Advocate Jag Mohan Saxena, Madhav Mitra, Prateek Kasliwal, Gauri Jasana, Gunjan Agrawal, and Kapil Prakash Mathur represented respondent Bar Council of Rajasthan and Bar Associations.

The Bench of Chief Justice Augustine George Masih and Justice Sameer Jain rendered the judgment which was rolled out today while nothing the arguments that “During the course of arguments, in unequivocal conjunction with the counsel who were party to the writ petition, the members of the Bar and various Bar Associations participated in the process of finding an amicable and harmonious solution to the issue at hand. Resultantly, in one voice, the Counsel for the parties have come-forth and duly attested to the suggestion so proposed, that elections to all the Bar Associations in the State of Rajasthan be held on a single day. In furtherance to the said resolution, a Suggestion has been put forth by the office bearers of the Bar Council of Rajasthan that the elections be held on the Second Friday of the month of December, depending upon and/or subject to the provisions, as contained in the Constitution of the respective Bar Associations.”
