The Allahabad High Court issued a directive on Thursday stating that the bail application for former MLA Mukhtar Ansari, who is facing a murder case, should be presented to the chief justice for consideration in a court specializing in cases involving Members of Parliament and Members of the Legislative Assembly. The bail application is connected to a murder that occurred in Uttar Pradesh's Mau district in 2010.
Justice Siddhartha issued the order in response to an objection raised by the additional advocate general of Uttar Pradesh concerning the jurisdiction of the case. The objection states that, as it involves a former MLA, the matter should be heard by a court designated for cases involving Members of Parliament and Members of the Legislative Assembly (MP-MLA court).
According to Mukhtar Ansari's legal representative, a contractor named Munna Singh was murdered in 2009 in Mau district. In the murder case, a person named Ram Singh served as a witness. Tragically, in 2010, Ram Singh was also killed.
Subsequently, a First Information Report (FIR) was registered at the Dakshin Tola police station in Mau district, alleging that Mukhtar Ansari was involved as a conspirator in the murder case.
In the current bail application, the applicant's legal counsel has argued that the primary accused in the case has already been granted bail. As a result, it is contended by Mukhtar's counsel that, since he is accused of having a role in the conspiracy and the main accused has already been granted bail, Mukhtar is also entitled to bail. Additionally, the counsel pointed out that Mukhtar has been in judicial custody for approximately 14 years in connection with this case.
