The Supreme Court of India issued a circular on 11.04.2023 saying that the after-notice transfer petition now could also be listed before a Division Bench.

Earlier the system of listing of Transfer petition was only before the Division Bench but later former Chief Justice of India Ranjan Gogoi changed the same and a new system of listing the transfer petition before the Single Bench was introduced. Supreme Court rules were amended to this effect.

Later the system was changed and the fresh transfer petitioner were getting listed before the Single Bench and after notice transfer petitions were listed before the division bench.

The circular says as under:-

"It is hereby notified for information of the Members of the Bar, Party-inpersons' and all concerned that the Competent Authority has been pleased to direct that henceforth after notice transfer petitions shall also be listed before Hon'ble Single Judge Benches, besides Hon'ble Division Benches. However, the fresh Transfer Petitions shall continue to be listed before the Hon'ble Single Judge Benches."
