Today, the Supreme Court considered a petition addressing the delay in the Central government's processing and notification of Collegium resolutions pertaining to the transfer and appointment of judges.
A division bench of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia highlighted the prolonged delays in appointing and transferring judges to both the high courts and the Supreme Court.
Justice Kaul said the transfer of 26 judges, and even the appointment of the Chief Justice of a "sensitive" High Court, is pending.
"70 names have been sent by high courts since November 2022, but they have not reached us.", Justice Kaul said.
“I am flagging this issue because vacancies are a big issue. We have not received any names for the past seven months. Recommendations are made, and then they are not appointed,” Justice Kaul said.
“Even names that have been reiterated have not gone ahead. Nine are pending without being returned. I have the data,” the Supreme Court judge said.
"I have the whole data. I wanted to say so much, but since the attorney is seeking time for a week, I am giving that. But I have made some things very clear- that I will take this case up every 10 days.”
During the hearing, advocate Prashant Bhushan raised concerns about candidates withdrawing their names due to the delay in appointments.
Prashant Bhushan also raised concerns about the Centre segregating candidates recommended by the Collegium. Bhushan emphasized the urgency of the situation, saying, "This cannot continue indefinitely."
Advocate Arvind Datar, appearing for the petitioners, stressed that segregating candidate names is detrimental to both the legal community and the candidates involved. Prashant Bhushan advocated for a more proactive approach, including the initiation of contempt proceedings against the Centre.
Justice Kaul concluded the hearing on Tuesday by reiterating his commitment to monitoring the matter closely, setting the next date for listing as October 9.
