The Kerala High Court has sought the response of the State government and the Director General of Police on a plea filed by a lawyer seeking compensation of ₹1 crore to the family members of Dr. Vandana Das, a 23-year-old house surgeon who was brutally murdered by a man brought to the hospital by the police for a medical examination. The court also ordered that the plea be tagged along with a pending matter connected to the same incident.
The petition, filed by advocate Manoj Rajagopal, a member of the State Committee of the BJP Legal Cell, highlights the need for adequate security in hospitals and the increasing incidents of physical attacks on doctors. The petitioner argues that the incident could have been prevented if the hospital had been provided with sufficient security. The plea alleges systemic failure, stating that the police present at the government hospital were inactive in defending against the accused person's illegal acts.
The petitioner further expresses concerns about potential foul play in the investigation, as the accused person is allegedly affiliated with a service organization associated with the CPI(M). The petitioner also points out material discrepancies in the police's narration of the incident in the First Information Report (FIR).
In addition to seeking compensation for the deceased doctor's parents, the petitioner requests that the court monitor the investigation into the case. The petitioner also calls for the court to issue guidelines ensuring the security of doctors, nurses, and other staff in hospitals across the State, as well as for the State government to provide armed police officials in all government hospital casualty wards.
The court has issued notice to the respondents and will consider the plea along with the pending matter related to the incident. The State government and the Director General of Police are expected to respond to the plea.
