The Supreme Court expressed its displeasure when the Union of India sought adjournment due to the non-availability of the Solicitor General of India in Delhi Riot conspiracy Case.
The Court sticky said that "If the Solicitor General is unavailable, alternative arrangments should be made."
When the case was called out on Tuesday in the first call, no one was present for Delhi Police and the case was passed over. When the case came up for hearing in the second call at about 4 pm, Advocate Rajat Nair assisting the SG appeared and sought an adjournment.
during this interaction Justice Kaul said, ""I saw him, but the point is how will this be heard?.
On this advocate requested to list the case next week and assured his presence.
Justice Kaul then remarked strongly, "We are supposed to be vellas. We will sit here and you will come when you feel like and go when you feel like."
He further said, "so somebody else should come, make alternative arrangements. SG must be required in many matters. Is this a matter for the Solicitor General? I dont even know that. Last time also we asked you to make alternative arrangments."
Once again the position is as on the last date of hearing. When the matter was called on the first occasion, the Solicitor General was not there and when it is called again it is stated that he was present sometime before and has again gone away. Solicitor General may be busy in many matters and this we have mentioned that alternative arrangements must be made. If during the next date of hearing alternative arrangements are not made, we will presume that the government has nothing to say in the matter. List the matter to 21st February. We are giving you last chance. Don’t do this next time. Please don’t make a request again. Because we will proceed to hear them and pass orders,”
