Very irritating: Don't keep mentioning again and again: CJI to Bilkis Bano advocate

When the case was mentioned before the Chief Justice of India by Advocate Shobha Gupta in the morning, the annoyed CJI made strong remarks "Writ will be listed. Don't keep mentioning again and again. Very irritating."

It is known that the Bilkis Bano Writ Petition was listed before the Bench of Justice Ajay Rastogi and Bela Trivedi when one of the judges Justice Bela M. Trivedi had recused from hearing the case.

Advocate Ms. Shbha Gupta mentioned the case before the Bench of the Chief Justice of India to form a new bench for the case and said that the petition was listed yesterday but not taken up.

CJI responded "So what? Don't keep mentioning this matter again and again. It will be listed. The review was also circulated yesterday."

Bilkis Bano has filed a Writ Petition before the Supreme Court for the remission granted to the 11 persons and released early by the State Government in the rape and murder case. All the accused were sentenced to undergo life imprisonment. Jaswant Nai, Govind Nai, Shailesh Bhatt, Radhyesham Shah, Bipin Chandra Joshi, Kesarbhai Vohania, Pradeep Mordhiya, Bakabhai Vohania, Rajubhai Soni, Mitesh Bhatt, and Ramesh Chandana are the 11 convicts who already stands released by the State Government.

When the case was listed before the Supreme Court for hearing, earlier this year, the bench headed by Justice Ajay Rastogi had directed the State Government to consider the remission application of the accused person as per police existing at the time of conviction in the state where the crime was actually committed.

The Supreme Court has its sitting this year till 16th December only and the present week has been declared as Misc Week. Yesterday, the Chief justice of India while hearing the mentioning applications, made observations that only 105 mentioning applications are listed. Kindly asked for listing only in those cases where it is really urgent. which cannot wait till the first week of January.
