Udhayanidhi to Madras HC: Onus of providing evidence on petitioner, not me

DMK leader Udhayanidhi Stalin, stated before the Madras High Court on Tuesday that the person who filed a complaint against him regarding his alleged comments against Sanatana Dharma should provide relevant evidence. He also emphasized that the court cannot force him to act against his constitutional rights.

The DMK also informed the High Court that BJP was engaging in "Twitter politics" based on the case against Udhayanidhi Stalin, who holds the position of Tamil Nadu Youth Welfare and Sports Development Minister.

During the hearing of the writ of quo warranto, which challenges one's right to hold public office, Senior counsel P Wilson verbally presented the aforementioned argument. The writ was filed by T Manohar, a member of the right-wing Hindu Munnani, against Udhayanidhi Stalin, and it came up for consideration before Justice Anita Sumanth.

Wilson argued that the proceedings of the case were being inaccurately represented on social media by members of the BJP, including K Annamalai, who serves as the State President of the BJP, on his Twitter account.

He stated that after filing a petition, it becomes the responsibility of the petitioner to provide the required evidence, and if they fail to do so, the petition should be dismissed.

Wilson added that the court cannot force the respondent, Udhayanidhi Stalin, to take any action that goes against his constitutional rights.

The judge scheduled the further hearing of the case for November 7. This decision came after Wilson and Advocate General R Shanmughasundaram requested additional time to prepare and file a counter affidavit in response to the application submitted by the petitioner.
