Transgender in Police posts: Maharashtra Govt. agrees to let them apply

The Government of Maharastra told the Bombay High Court on Friday that it would allow persons of "the Third Gender" i.e. Transgender apply in the selection process of police constables in the current statewide recruitment process and frame rules setting standards for their physical tests by February 2023.

When the case was listed for hearing last week, the Bombay High Court taking serious note of the issue, warned the Maharastra Government to let the persons of the Transgender Category apply for the same recruitment or the entire process would be at a halt. Advocate General Ashutosh Kumbhakoni expressed before the court of Chief Justice Dipankar Datta and Justice Ajay Ahuja that the Government would modify its website giving an option for the third category while filling out the online application form. The AG further told the Court that for the present, persons of the third gender would be able to apply only for the post of Constable Driver as its teams are homogenous of men and women for group activity.

The AG told the Court that by 13th December the "drop-down" would be added for the third gender and the last date for applying for the post is 15th December. The bench passed an order that "It is directed that till rules are framed and physical tests are conducted, the state shall not process, to conduct written test."
