The Telangana High Court has initiated a Public Interest Litigation advocating for the establishment of at least one old age home within each district.
Chief Justice Alok Aradhe and Justice Anil Kumar Jukanti, comprising the Division Bench, accepted the Public Interest Litigation following a letter directed to the Court, and have subsequently issued a notice to the State regarding the matter.
The correspondence highlighted Section 19 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, emphasizing the obligation on the State Government to establish a minimum of one old age home in each district, capable of accommodating up to 150 financially disadvantaged senior citizens.
Additionally, the letter highlighted that the current state of existing old age homes is deteriorating, lacking in essential amenities. It emphasized that the inability to maintain or set up adequate old age homes infringes upon the fundamental rights guaranteed under Article 19 and 21 of the Constitution, which safeguard various freedoms and protections for individuals.
In its critique of the State, the letter highlighted that the State's inactivity in establishing proper old age homes has led to a distressing situation where numerous senior citizens are compelled to reside in inadequate conditions, either on the streets or in deplorable living conditions.
