Supreme Court permits service through Whats app

In a recent decision made by the Supreme Court, the bench of Justices Vikram Nath and Rajesh Bindal, granted permission to a litigant to effect service through WhatsApp.

This major decision was made in response to a transfer petition filed by a wife seeking to move a divorce case initiated by her husband before the Principal Judge of the Family Court in Nashik.

The wife's legal counsel argued that her husband, who serves in the Border Security Force (BSF) stationed in Jammu and Kashmir, has been elusive, making it challenging to serve legal notices to him.

In light of these circumstances, the Supreme Court allowed the petitioner to employ WhatsApp as a means of serving notice upon the lawyer representing the husband in the matrimonial case before the Family Court in Nashik.
