Supreme Court Judge approached by Litigant, Lawyers hit out

Today in a Bizzare incident A bench headed by Justice BR Gavai and CT Ravikumar of the Supreme Court of India told senior advocates appearing in a case Mr. Dushyant Dave and Mr. Atmaram S. Nadkarni that one of them was approached by the litigant and they want to recuse from the case and put the case before another bench.

On this both the advocate appearing for the parties strongly opined against recusal of the bench because of the misdemeanor of a litigant. Sr. Advocate Dushyant Dave said "This is a cheap tactic to make a judge recuse from a case.  We must protect judges and the institution from such attempts"

On this, the Bench said, "This is the only institution where people by and large repose faith. Such attempts should be dealt with iron hand."

In the order, the bench said, "Dave for the appellant and Nadkarni for the respondent requested the bench to continue hearing the matter. We accede to the request of the parties and post the matter for further hearing on September 21.

The case was listed in Court no. 13 of the Supreme Court as Item No. 32 titled as Bishamber Prasad V. Arafat Petrochemical Ltd. &Ors. SLP (C) No. 14970/2021 on 07.09.2022.
