The Supreme Court of India has Constitued 7 judges Constitutional Bench to hear the case wherein the Court has to decide the Criminality of Member of Parliament liable for accepting bribes in exchange for actions or inactions within the legislative chamber.
These 7 judges comprises of CJI DY Chandrachud, AS Bopanna, MM Sundresh, JB Pardiwala and Manoj Mishra and two newly added judges, Justice Sanjay Kumar and Justice Narasimha
Last week, the five judges bench of the Supreme Court referred the matter of immunity enjoyed by the members of parliament and the legislative assembly to a bench of 7 judges.
Five judges bench comprised of CJI DY Chandrachud, AS Bopanna, MM Sundresh, JB Pardiwala and Manoj Mishra heard the matter for the whole day and had given certain immunities to the members of the Parliaments for the bribe taken by them outside the house for something doing in parliament or not doing in the parliament.
While rising the chief justice indicated that this issue has been pending for a long period of time and this bench has heard the matter substantially, therefore, he will add 2 more judges to the same bench and settle the controversy once and for all.
While hearing the matter, CJI DY Chandrachud had orally remarked–
"We must also not ignore that if it also furthers public morality on part of our elected representatives, then we should not defer our decision to some uncertain day in the future. Isn't it?"
Two new judges, Justice Sanjay Kumar and Justice Narasimha, have been added to the bench. The next court hearing is scheduled for October 4th and will also feature two new judges. The Center was represented by the Attorney General of India, R Venkataramani, while PS Patwaliya serves as the Amicus Curiae in the case.
Among the other advocates involved is Gopal Shankar Narayan.
