Supreme Court Extends Interim Bail of BSP Leader Uday Bhan Singh in 1999 Murder Case

Today, on June 28, the Supreme Court extended the interim bail of BSP Leader and Former MLA Uday Bhan Singh, who was convicted in a 1999 murder case. Additionally, the Court has issued a notice regarding his contempt petition, which alleges inaction by the State Authorities following the order directing his premature release.

The vacation bench comprising Justices AS Oka and Ahsanuddin Amanullah heard a contempt petition filed by Singh against Mr. Deepak Kumar, Principal Secretary of the Department of Home Secretariat, Uttar Pradesh, alleging violation of a previous court order dated April 29.

According to the April 29 order, the Supreme Court allowed the writ petition for the premature release of the MLA. Granting him the benefit of parity, the Court noted that three of his co-accused had already been released prematurely. The State Authorities were instructed to process his release application within six weeks from the date of the order. Singh was granted interim protection until July 9 before surrendering.

The bench, while issuing notice, directed the Principal Secretary to immediately comply and issue orders in accordance with the directions of the April 29 Order. Additionally, Singh was granted an extension of time to surrender, now until July 26.

"Issue notice to respondent returnable on 26th July. We expect the respondent to make compliance immediately with the order dated 29th April 2024 and place the order passed on record. In the meanwhile, we extend the interim bail granted to the petitioner under the order dated April 29, 2024 till the returnable date."

The matter relates to MLA Singh's conviction in a 1999 criminal case for the murder of three persons, along with 10 other co-accused, by the Trial Court. Singh was sentenced to life imprisonment and has served 20 years and 7 months in actual custody so far.

The matter will now be heard on July 26.

The petition was filed with the assistance of AOR Divyesh Pratap Singh.
