Supreme Court disposes AAP MP Raghav Chadha's suspension challenge

In a recent turn of events on December 4, the Supreme Court of India has addressed the revocation of Aam Aadmi Party (AAP) MP Raghav Chadha's indeterminate suspension from the Rajya Sabha. The court therefore dismissed Chadha's plea challenging the suspension, which was lifted on the same day by a motion moved by BJP member GVL Narasimha Rao through a voice vote in the Rajya Sabha. The Privileges Committee had earlier found Chadha guilty of presenting "misleading" facts in front of the media.

Chadha, while representing Punjab in the upper house, was permitted to attend the House proceedings following the withdrawal of his suspension. When Chadha's plea was brought before a three-judge bench, headed by Chief Justice D Y Chandrachud composed of Justice J B Pardiwala and Justice Manoj Misra, his counsel, Shadan Farasat, informed the court about the suspension that had been revoked.

Considering this recent development, the bench had declared the petition irrelevant and disposed it of. Expressing gratitude, Farasat acknowledged the bench's involvement in the matter. The Supreme Court had earlier postponed the hearing on December 1, based on Solicitor General Tushar Mehta's statement representing the Rajya Sabha Secretariat, indicating that "something constructive" was likely to happen soon.

On November 3, the Supreme Court advised Chadha to offer an unconditional apology to Rajya Sabha Chairperson Jagdeep Dhankhar regarding the select committee dispute. The court also suggested that Dhankhar might consider it with sympathy.

Chadha had been facing suspension since August 11, following accusations by several MPs, predominantly from the ruling Bharatiya Janata Party (BJP), alleging that he included their names in a motion without obtaining their consent. The motion was aimed to establish a select committee to scrutinize the controversial Delhi Services Bill. Responding to the complaint, the Rajya Sabha chairman suspended the AAP leader pending an inquiry by the Committee of Privileges.
