On January 6, a Supreme Court division bench led by Justices MR Shah and CT Ravikumar dismissed BJP leader Subramanian Swamy's petition seeking to annul an alliance between Jet Airways and Abu Dhabi-based Etihad Airways as withdrawn.
The Bench stated , "The petitioner seeks permission to withdraw the plea in view of subsequent developments. The petition stands dismissed as withdrawn".
If a new cause of action arises in the future, the Bench also allowed him to file a new application.
On April 24, 2013, Jet Airways decided to sell a quarter of its equity to Etihad Airways for approximately Rs 2,058 crore as part of a strategic alliance that would result in a significant expansion of their global network.
According to reports, Swamy sought to set aside and revoke any action or decision or grant of any further approvals/permissions/permits, etc. by Government authorities in furtherance of the April 24 decision in his PIL filed in 2013.
On December 6, 2013, the Court served notice on the Centre, Ministry of Commerce, Ministry of External Affairs, Foreign Investment Promotion Board, Department of Industrial Policy and Promotion, Directorate General of Civil Aviation, Jet Airways, and Etihad Airways, among others.
Jet Airways ceased operations in April of this year.
