Yesterday, Delhi High Court issues a notice to the producers of the movie "Nyay: The Justice," which is based on the life of the late actor Sushant Singh Rajput. This move comes in response to a plea filed by Rajput's father, Krishna Kishore Singh, seeking to prevent the streaming of the film on Over The Top (OTT) platforms.
Krishna Kishore Singh approached the High Court after an order dated July 12, 2023, was issued by a single judge of the High Court, which declined to halt the film's streaming.
A division bench consisting of Justices Yashwant Varma and Dharmesh Sharma has requested responses from the movie's producers and has scheduled further consideration of the case for November 16.
Released in June 2021, the film is available for streaming on the OTT platform "Lapalap Original."
In a detailed ruling on July 12, Justice C Hari Shankar stated that Sushant Singh Rajput's personality rights, as well as his rights to privacy and publicity, ceased upon his death. These rights are not inheritable and cannot be advocated by his father, according to Justice Shankar's judgment.
The single judge further pointed out that even if the film were found to infringe upon Rajput's publicity rights or defame him, these rights are personal to the actor and are not passed on to his father.
Based on these considerations, the single judge concluded that an order to halt the film's streaming cannot be issued, especially when the movie has already been released and likely viewed by many individuals.
