Sr. Adv. advised to improve and mend himself by Raj. HC: directs not to list his cases before bench

The Single Bench of Rajasthan High Court Justice Birendra Kumar recently made strong comments against a Senior Advocate Mr. AK Gupta of Rajasthan High Court at Jaipur.

The Court used very strong words "However, the Court maintains utmost restraint in not initiating contempt proceedings against Senior Advocate Mr. A.K. Gupta to give him one more opportunity to improve and mend himself to maintain the dignity of the Courtroom and to ensure the independence of judicial system."

The Court did not stop to this and directed the registry of the court not to list his matter before his court.

This view of the HC came in a petition argued by Gupta for quashing of FIR registered at Aravali Vihar Police Station, Alwar.

The Court was firstly of the view of disposing of the same with another similar petition. Gupta appearing for the accused insisted on passing interim order. The Court was of the view that the court would dispose of the petition itself after hearing at length.

The court further noted that "However, learned Senior counsel chooses to pressurize the Judge by hooks and by crooks consistent with his past behaviour in other court rooms for instant hearing and order in favour of the petitioner before allowing the court to take up any other matter. The behaviour and action of the learned Senior counsel of intimidating a Judge sitting in court room not to act with judicial independence amounts to contempt of court. The action depicted in open court room is unbecoming of an advocate what to talk of a senior advocate."
