The Supreme Court said that sexual harassment in any form at the workplace should be taken seriously. The harasser should never be allowed to escape the clutches of the law.
Along with this, the top court has canceled the decision of Gauhati High Court in which the order of fine withholding 50 percent pension of a former Service Selection Board officer Dilip Pal was cancelled. He was accused of sexually harassing a female subordinate.
A bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra said that sexual harassment is an issue that has plagued societies across the world. It has become widespread and deeply rooted. This has been a matter of serious concern in India also. The new laws enacted to combat sexual harassment are a testament to the country's commitment to addressing this problem.
The bench said that when a plea of false allegation is made, it is the duty of the court to examine the evidence thoroughly and see whether the allegations are true or not. Take a decision based on that. The genuineness of the complaint should be investigated in such a way that the laws made for the upliftment of the society and equal rights of the people are not misused.
The concerned officer was working as an area coordinator in Rangia, Assam between September 2006 and May 2012. In connection with the disciplinary proceedings initiated on allegations of sexual harassment, 50 percent of Dilip Pal's pension was ordered to be stopped forever. It was canceled by the High Court. Pal was accused of sexually harassing a female employee working as a field assistant under him.
