SC to examine Validity of Citizenship Act's Section 6A in Assam Immigrant Case on December 5

The Supreme Court on Monday said it will begin hearing on December 5 to examine the constitutional validity of Section 6A of the Citizenship Act, relating to illegal immigrants in Assam. In the Supreme Court, a bench headed by Chief Justice DY Chandrachud told Solicitor General Tushar Mehta.

After mentioning the matter, the matter has been postponed till December. A five-judge constitution bench was scheduled to hear the matter on Tuesday.

Section 6A was added to the Citizenship Act as a special provision to deal with the citizenship of people covered under the Assam Accord. The provision mentions that people who have come to Assam from specified areas including Bangladesh on or after January 1, 1966, but before March 25, 1971 and have been residents of Assam since then, as per the Citizenship Act amended in 1985, should consider themselves as citizens of Assam. For this, registration will have to be done under Section 18.

In his statement, the Solicitor General said, "I am mentioning on my own behalf and on behalf of the Attorney General of India. The matter coming up tomorrow is the Citizenship Amendment Act. If the matter can be postponed a little...it will be before Diwali." It's the last working week and we just came out of a constitution bench and so, we need some time."
