SC Slam Patanjali for Continuing Misleading Ads; Apologies Rejected

The Indian Medical Association (IMA) filed a case against Patanjali Ayurveda, alleging that the company engaged in a misinformation campaign and marketing strategy to boost sales of its products through misleading claims. Patanjali initially assured the court that it would cease making such statements.

However, the misleading advertisements persisted, prompting the court to initiate contempt proceedings against Patanjali, MD Acharya Balkrishna, and co-founder Baba Ramdev.

In these proceedings, Patanjali, Baba Ramdev, and Acharya Balkrishna offered apologies to the court, which were rejected. Subsequently, Patanjali published an apology in the newspaper, mentioning Baba Ramdev and Acharya Balkrishna.

The court criticized the Uttarakhand state licensing authorities for their inaction, noting that while some affidavits had been filed, others were still pending. On the last hearing date, July 9, the Uttarakhand licensing authority submitted an affidavit, but the IMA requested more time to file a counter-affidavit. The court considered an additional affidavit filed by Patanjali and directed intermediaries and social media platforms to remove advertisements related to the 14 Ayurvedic medicines whose licenses were suspended by the Uttarakhand state licensing authorities.

Despite these orders, the parties did not respond adequately, leading the court to direct Patanjali to file an affidavit and issue notices on multiple interlocutory applications filed by organizations such as the Internet and Mobile Association of India, the Association of Radio Operators for India, the Broadband India Forum, and the Indian Newspaper Society.

ASG KM Nataraj informed the court that the Ministry of Information and Broadcasting was holding high-level meetings with various stakeholders to resolve the issues
