The Supreme Court is poised to announce its decision regarding the abrogation of Article 370 on December 11. A five-judge bench, led by Chief Justice DY Chandrachud and including Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai, and Surya Kant, is set to deliver the verdict on a series of petitions challenging the revocation of Article 370, which granted special status to the former state of Jammu and Kashmir.
Following extensive hearings spanning over 16 days starting in August, the bench, on September 5, opted to withhold its decision on the matter. The petitioners contested the government's actions on August 5, 2019, which involved the revocation of both Article 370 and Article 35A. These articles granted special status to Jammu and Kashmir. Article 370, coupled with Article 35A, provided Jammu and Kashmir with unique constitutional privileges, including the ability to maintain a distinct constitution and a separate penal code, among other legal distinctions, under the framework of the Indian Constitution.
During the August hearings, the petitioners argued that the Central government was acting in its self-interest and not adhering to the established legal principles of the land.
