SC set aside Gauhati HC orders, Upholds MLA Dasanglu Pul's 2019 Election in Arunachal Pradesh

Today, the Supreme Court set aside the Gauhati High Court's ruling that had nullified the 2019 election of Dasanglu Pul, the BJP MLA representing Arunachal Pradesh in the State Assembly.

A division bench of Justices AS Bopanna and PS Narasimha allowed the appeal filed by BJP MLA and rejected the election petition filed against her election. 

Earlier in May, the Supreme Court had granted interim relief to Dasanglu Pul. They had ordered that no bye-election should take place in the constituency she represented while her petition was under consideration by the Supreme Court. Furthermore, the Court stated that Dasanglu Pul would be entitled to all the privileges of a Member of the Legislative Assembly and could actively participate in legislative proceedings and committees.

Dasanglu Pul, the widow of former Chief Minister Kalikho Pul, was elected from the Hayuliang Assembly constituency in 2019.

The High Court in its order on an election petition filed by her opponent in the election Lupalam Kri alleging that she had not disclosed six properties of her late husband in the election nomination form.

The Court invalidated her election on the ground that she had not presented her nomination paper in accordance with Section 33 of the Representation of the People Act, 1951 and that the same was liable to be rejected.
