SC seeks guidance of ASG in seeking permission to terminate pregnancy

On January 23, the three-judge Supreme Court bench, presided over by Chief Justice of India D.Y. Chandrachud, Justice V. Ramasubramanian, and Justice J.B. Pardiwala, requested Ms. Aishwarya Bhati to speak with the 20-year-old unmarried woman and offer advice in connection with her petition asking for permission to end a 29-week pregnancy. 

In the most recent instance, a bench presided over the Chief Justice of India D.Y. Chandrachud instructed AIIMS to form a committee to determine whether medical termination is possible without endangering the petitioner's life.

The report of the Committee was given to the counsel for the petitioner and the Additional Solicitor General of India on Monday by a Bench. 

According to the study, a C-section would need to be performed in order to terminate the pregnancy at this point, and there is a good chance that the baby would survive. The CJI stated that this case was distinct from the prior one where abortion was permitted in light of this report. In light of this context, the Court asked the ASG to assist the petitioner.

The Committee established by AIIMS has additionally recommended that the petitioner seek counseling from the mental OPD at AIIMS. 

The petitioner is currently taking her examination, which will last until the end of the month, the petitioner's attorney informed the bench. In light of this, he pleaded with the Bench to revisit the issue later. 

The matter has been scheduled to be heard on February 2, 2023.
