SC scolds state of Rajasthan on non-appearance despite service; directs to improvise the procedure of appearance of advocates

The bench of Justices Dinesh Maheshwari and Hrishikesh Roy took serious note of the fact in an anticipatory bail matter of the State of Rajasthan when no counsel appeared during the first call despite the service was complete on the State of Rajasthan.

The bench had granted protection to an accused when the matter was listed before it in December, 2022 and called upon the State of Rajasthan by issuing notice.

When none appeared for the State of Rajasthan in the first call, the bench called an advocate for the State of Rajasthan and Additional Advocate General Manish Singhvi appeared for the State. 

Justice Maheshwari took serious note of the fact and made remarks that it is the usual practice of the State of Rajasthan. No one appears in the court when the matter is called out despite service.

On this AAG Manish Singhvi said that we are in the process of streamlining the system of marking matters to advocates representing the State before the Supreme Court.

On this, the court passed a judicial order directing the State of Rajasthan to improve its system of appearance before the Court and granted 4 weeks to the State to take necessary instructions in the matter, and adjourned the case.
