SC rejects plea seeking validation of centre's decision to revoke J&K's Article 370 special status

The Supreme Court has rejected a Public Interest Litigation (PIL) seeking validation for the abrogation of Article 370(1) and the removal of Article 35A in Jammu and Kashmir.

Chief Justice DY Chandrachud, heading the bench with Justice JB Pardiwala and Justice Manoj Misra, expressed doubts about the petition's intent and questioned its purpose. The PIL aimed to secure a formal declaration of the constitutional validity of the government's decision. However, the court highlighted that the issue of constitutional validity is already before them, making the plea redundant. The plea was consequently dismissed.

Article 370(1) was revoked on August 5, 2019, removing the special status of Jammu and Kashmir, while Article 35A, which granted specific privileges to its residents, was also deleted.

A constitution bench is currently reviewing challenges to the abrogation of Article 370(1) and the deletion of Article 35A. The court deemed the present PIL unnecessary, as the question of constitutional validity is under its consideration.

The Chief Justice's skepticism over the petition's nature and purpose suggests a cautious approach to judicial involvement in matters already under examination. This dismissal underscores the ongoing judicial scrutiny of the government's actions and the complexities of constitutional amendments.
