SC rejects petition seeking approval of DNA testing to resolve Paternity Disputes

The Supreme Court has rejected a petition seeking approval of DNA testing to resolve paternity disputes across the country. The Supreme Court said that he cannot run the entire system.

This petition came up for hearing on Monday before the division bench of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia.

The Supreme Court found that it is very difficult to accept such demand made in the petition on the basis of the entire country. The division bench told the petitioner that one such case can be resolved, but the court cannot give a verdict on the entire system.

The division bench told the petitioner under Section 112 of the Indian Evidence Act that a child born under a valid marriage would be considered legitimate. So what kind of petition is this? Who is personally appearing in this case? Do you want DNA tests to be conducted across the country?

The division bench asked the petitioner whether he had any personal litigation. To this the petitioner agreed and said that they have a seven year old dispute on this issue. Rejecting the petition, the division bench said that it is very difficult for the entire country to accept this demand, whereas this demand is also being made because the petitioner has some pending issues in this regard.
