The Supreme Court has rejected a request for police protection from Shrikant Tyagi, a politician based in Noida, who had been arrested in August the previous year on charges of assaulting a woman in a Noida housing complex. Tyagi gained limelight when a video depicting him verbally abusing and physically assaulting a female resident in his Noida community went viral on social media.
The woman had reportedly expressed her opposition to Tyagi's planting of trees within the Grand Omaxe Society premises in Sector 93B, Noida.
Tyagi faced charges of both physical assault and verbal abuse against the woman.
A bench of Justices Bela M Trivedi and S C Sharma said it was not inclined to interfere with the Allahabad High Court judgment.
"We are not inclined to interfere with the judgment impugned herein under Article 136 of the Constitution of India. The petition for Special Leave to Appeal is dismissed," the bench said.
The Supreme Court was reviewing an appeal submitted by the politician, contesting the judgment of the high court dated July 4. The high court had rejected his plea, asserting that "an individual who resorts to violence and disregards the sanctity of human life forfeits the right to request the state's intervention in safeguarding their life from adversaries."
"In our opinion, providing personal security would bolster the activities of such person to the detriment of the society at large. A person, who has chosen violence and does not have any value of human life, has no right to plead that the State should take special measures to protect his life from his rivals. "The threat perception, if any faced by such a person, is of his own making for which the State can not come forward to provide him security," the high court had said.
In response to inquiries regarding the sequence of events that precipitated the confrontation, Tyagi explained that he had planted palm trees in the vicinity of his ground floor flat. He elaborated, "The builder levied an additional 5 percent charge for ground floor flat purchasers, designating it as a prime location fee. In exchange, buyers were promised a green area adjoining their flats, a provision clearly stipulated in the property registration documents. We planted palm trees in that area in 2019, but subsequently, individuals began accusing us of encroachment."
When questioned about his purported connection with Swami Prasad Maurya, who defected from the BJP to join the Samajwadi Party before the 2022 Uttar Pradesh election, Tyagi clarified, "I never sought any assistance from Mr. Maurya, and he did not provide me with any help."
The Uttar Pradesh administration took rigorous actions against Tyagi in response to the video depicting him verbally abusing the woman at Noida's Grand Omaxe society, including the demolition of allegedly unauthorized structures at Tyagi's property.
