SC rejected a plea seeking Supreme Court land for construction of chamber block for lawyers

Today, the Supreme Court of India rejected a plea seeking Supreme Court land for the construction of chamber block for lawyers. The plea was filed by Supreme Court Bar Association (SCBA). The division bench of Chief Justice of India (CJI) DY Chandrachud with Justices Sanjay Kishan Kaul and PS Narasimha noted that the said land was allotted to the Supreme court for housing archives.

The Court held that the land cannot be transfer to SCBA for construction of chamber block for lawyers. 

"SCBA cannot assert a right on the entirety of the land alloted to Supreme Court for housing Supreme Court archives. The petitioner has sought conversion of entire area around Supreme Court on Bhagwan Das road. Such directions cannot be issued on judicial side," the Court said.

"We leave it open to the Supreme Court of India to take this up on the administrative side. The process would entail discussion with SCBA, SCAORA and other bar members. Plea stands disposed of," the Court said.

Case Brief -

The matter had been a cause listing of the Petition to convert the land measuring 1.33 acres that were allotted to the Supreme Court for developing the chamber blocks for lawyers a small augment was held between the Chief Justice of India Dr DY Chandrachud, and the President of the Supreme Court Bar Association (SCBA), Senior Advocate Vikas Singh.

In response, the CJI had asked Singh to leave the court immediately and said that he would not be intimidated and that Singh would be treated only like any other litigant.

"You cannot expect the bench to be cowered down. I have never been browbeaten, and I will not let this happen in final two years of my career. You can pursue your political agendas outside the court hall."

The CJI had also reminded Singh that he was asking for land allotted to the Supreme Court to be given to lawyers under Article 32.

Interestingly, after the heated exchange in CJI Chandrachud's court, Senior Advocates Kapil Sibal and Neeraj Kishan Kaul apologised for Singh's conduct.

Earlier, Senior Advocate, Vikas Singh wrote a letter to the Chief Justice of India Dr DY Chandrachud for listing and hearing the matter as soon as possible. In its letter, he also mentioned that he hoped that SCBA was not forced to resort to protesting due to not being treated as an ordinary litigant and being given unfair treatment by not being given its due importance.

Before that, he had also written to former CJI UU Lalit regarding the same matter. After a long time when Senior Advocate Vikas Singh did get any satisfactory response, he got into a heated exchange with the CJI and said that he didn't wish to take the matter to the judges' residents.

After that CJI responded and said that this is not the right way to behave and ordered Mr Singh to sit down.

On March 17, in a separate letter to the CJI, Singh stated the infrastructure at the top court has not kept pace with the needs of the bar.

He requested that the SCBA be permitted to use the three new auditoriums and meeting rooms.

Currently, the SCBA occupies a cramped room next to the press lounge, Singh pointed out. The same proves inadequate for purposes like meeting foreign dignitaries or delegations, Singh's letter stated.
