The bench of the Supreme Court comprising, Justice BR Gavai, Justice PS Narasimha and Justice Prashant Kumar Mishra refused to Intervene in Cauvery River Dispute, Upholding CWRC Order for Karnataka to Release 5000 Cusecs to Tamil Nadu.
The order pertains to the period of 13th to 27th September. The order passed by the Cauvery Water Regulatory Committee (CWRC) was affirmed by the CWMA.
The Supreme Court noted that both the CWMA and CMRC comprise experts in the domains of water resource management and agriculture.
Further, the Court noted that the CMRC had diligently considered factors such as the water shortage this year and the escalating distress conditions in the Cauvery basin over the past 15 days. The Court also highlighted that the situation is subject to continuous monitoring by the relevant authorities, with updates occurring every 15 days.
Senior Advocate Mukul Rohatgi, representing the state of Tamil Nadu, argued that although both the CWMA and CWRC have acknowledged the state's eligibility for the release of 7200 cusecs, it has been reduced to 5000 cusecs. He emphasized that this is a distressing year for everyone and highlighted Tamil Nadu's status as a lower agrarian state.
On the other hand, Senior Advocate Shyam Divan, representing the state of Karnataka, conveyed to the Court that the CWMA's order is not in the state's favor, yet Karnataka is complying with it.
"Karnataka doesn't even get the benefit of the North East Monsoons". he argued.
"There are rival claims, Tamil Nadu is saying they need 7200 cusecs, Karnataka is saying they can only give 2000 cusecs. We are not inclined to interfere. Every 15 days they [CWMA and CMRA] are monitoring and reviewing it. It is a body consisting of various experts and they have given their reasons." Justice Gavai said during the hearing.
